If you rented a property in England or Wales and paid a tenancy deposit, your landlord will usually need to protect it in a government-approved tenancy deposit scheme. The Deposit Protection Service (DPS) is one of those schemes. But what happens if your landlord didn’t protect your deposit at all, or protected it too late?
How do I know if my deposit was protected?
If your landlord says your deposit was protected with DPS, you can check with the scheme. You should also have been given information about how your deposit was protected, including details about the scheme and the arrangements for getting your deposit back. If you can't find any of this information, or DPS has no record of your deposit, that's worth investigating.
What if my landlord never protected it?
This is where things get more interesting. Under the rules governing tenancy deposits, a landlord who takes a deposit is generally required to protect it within the relevant deadline and provide the tenant with the required information. If they don't, a tenant may be able to bring a claim against the landlord. Depending on the circumstances, a court can order the landlord to pay the tenant between one and three times the amount of the deposit, in addition to dealing with the deposit itself. So if your deposit was £1,000, the potential penalty could be significant.
What if they protected it late?
Being protected eventually doesn't automatically make the original problem disappear. If your landlord took your deposit and failed to comply with the deposit protection requirements within the required timeframe, the circumstances of the late protection can matter. That's why it's important to look at when the deposit was paid, when it was protected, and what information you were given.
